Once your booking is confirmed you accept the following terms and conditions:
1 Reservation and acceptance
3.1 Escocia Tours takes no responsibility for the delay or cancelation of the service, or any damage caused by a criminal or terrorist act, industrial disputes or strikes, riots, invasion, war or threats of war, fire, explosions, radioactive contamination, storms, flood, epidemics, illnesses or any natural disaster, extreme weather conditions, traffic, technical interruption or any other events out with the control of Escocia Tours.
4.1 You accept that the electronic communication between Escocia Tours and the client complies with the same legal requirements as if these communications were written
5.1 Escocia tours complies with the required legal insurance
5.2 The price does not include travel insurance. It does not include insurance regarding medical, cancelation, personal accident, baggage or civil responsibility. We recommend that you obtain travel insurance which covers cancelations, medical expenses, personal accidents, personal belongings and civil responsibility before starting the tour, as well as a European health card if you are entitled to one.
5.3 Escocia Tours takes no responsibility for loss of or damage to luggage or any other type of personal belonging, or any civil responsibility for physical harm or death, other than any responsibility we have by law
5.4 Escocia takes no responsibility for any accident, harm or death caused by the client in one of our walking tours while the client has free time in a village, city or natural space where we have stopped or in accommodations or tourist attractions that we have reserved for the client. Any accident or death occurred inside tourist attractions or accommodation is not the responsibility of Escocia Tours. The client must refer to the tourist attraction or accommodation in question, consult their terms and conditions and take legal action directly with the tourist attraction/accommodation.
Any accident or death caused during any activity after having left our vehicle is not the responsibility of Escocia Tours.
5.5 the price does not include any extra services
5.6 the price is given in GDP. Escocia tours reserves the right to change the prices without warning. We will always respect the price agreed at the time of booking.
6.1 Escocia tours takes no responsibility for third parties, such as closure of attractions or events out of our control. We have no responsibility for failure or negligent acts or any contractor, unless this person is an employee of Escocia Tours.
6.2 Reservations made with third party companies are subject to their terms and conditions
7.1 Escocia Tours takes no responsibility for the cancelation policy of accommodation providers
7.2 Accommodation services are provided independently by third party providers. The contract is made between the client and the accommodation provider. These agreements are made independently from Escocia tours, even if Escocia Tours helps to reach these agreements.
8.1 Escocia Tours will only cancel tours in the event of circumstances out with our control.
8.2 1-day trips: If you wish to cancel a tour after booking, the effective date will be when Escocia Tours receives written notification. The client will incur the following charges for 1-day tours:
8.3 Multi day tours. If you wish to cancel the contracted service after booking, the effective date will be when Escocia Tours receives written notification. The client will incur for the following charges for multi day tours:
8.4 If your booking has been confirmed and you wish to change dates or change trip you must contact us to consult our availability at least 3 days before the departure
8.5 If your reasons for cancellation are covered by an insurance policy, you must make your claim under your insurance policy’s procedure.
9.1 the minimum number of people necessary for the departure of a regular tour will be assigned by Escocia Tours and informed to the client. The company reserves the right to cancel any tour in which, 10 days before the scheduled departure, the minimum number of people has not been reached. When this happens, the company will inform the client, and offer an alternative subject to availability. Alternatively, Escocia tours will refund the total amount of the tour if this has been paid
10.1 On 1-day tours baggage is limited to one backpack per person
10.2 For multi day services a medium suitcase and a handbag or small backpack is permitted
10.3 Escocia Tours takes no responsibility for loss, theft or damage to baggage, money or personal items
11.1 Children under the age of 5 are not allowed in regular services. if you wish you can consult us for private services.
11.2 Children under the age of 16 must be accompanied by an adult responsible for them
12.1 Any illness of physical condition that requires attention or treatment must be informed to us
12.2 It is not permitted to smoke, eat or drink alcohol inside the vehicle.
12.3 Escocia Tours takes no responsibility for lateness of a passenger which could affect the other passengers or the planned tour, so we ask you to respect the times given to you. The service will be continued without late passengers if they have not presented themselves 15 minutes after the agreed time, to respect the schedule or other passengers.
12.4 It is your responsibility to respect and obey the laws and rules of the country including customs and visa restrictions
12.5 the client accepts that we can use any text written in our commentary book or page. The client accepts they can be photographed or filmed whist contracting the services of Escocia Tours and this material can be used as advertising material, without needing approval from the client.
12.6 Any complaints regarding Escocia Tours must be made to a representative of Escocia Tours immediately. If this is unable to be resolved, a written complaint must be made within 28 days of contracting the service. After this time has passed, no complaints will be considered.
12.7 If any part of this contract is not valid or is inapplicable in court, this part will be rewritten to give effect to the same objective within the limits of the law. The validity and application of the other parts will not be affected
12.8 In case of legal action against Escocia Tours, you agree to pay all costs, including but not limited to the cost of a defense lawyer.
12.9 These conditions will be construed and read in accordance with the law in Scotland and all parts will submit to the jurisdiction of the Scottish Court. Any trial must therefore take place in Scotland
13.1 The payment will be processed by bank transfer or a secure and protected payment platform
12.2 when you make a booking, you authorize the payment from your card or online payment account
13.3 Payment will be made in its totality
13.4 When you pay your booking by credit or debit card, certain tests can be done including obtaining authorization from your card provider to ensure that you have sufficient funds and for security purposes. This can include the validation of your name, address and other personal information from appropriate third parties including the card provider, credit reference agencies and fraud prevention agencies.
13.5 You declare that all information you provide at the time of booking is correct, that the card you are using is yours and that you have sufficient funds to cover the cost of the contracted service.
13.6 You authorize Escocia Tours to transmit the payment information you give during the booking, or any other information, to obtain authorization from your card provider to ensure you have sufficient funds, to confirm your identity, to check the validity your payment card and for other security reasons, such as fraud prevention.
14.1 A private tour means that no other client can join the group and only the number of people specified at the time of booking can travel in the vehicle.
14.2 You have contracted a specific route and have accepted to proceed with the payment. During the tour, the guide may demonstrate certain flexibility, but will not accept dramatic changes which affect the number of kilometers or the time scale.
14.3 It is not possible to change the working hours of the guide. Normally for private tours, except if you contract the tour under other terms and conditions, start every day between 8am and 9am and finish in your accommodation between 17h and 19h. This allows us to ensure that our guides can rest and be in an optimum state the next day. Security on the road is fundamental for us, and the guide’s rest directly affects this. We appreciate greatly that you respect the scheduled times that your guide indicates to you in each stop. We have a moral, legal and ethical obligation to establish working hours for our guides.
